Aerotropolis planning proposals must match the 2020 Aerotropolis Plan.
Applies to: Western Sydney Aerotropolis land (Chapter 4 of SEPP (Precincts–Western Parkland City) 2021) in Blacktown, Blue Mountains, Camden, Campbelltown, Fairfield, Liverpool, Penrith and Wollondilly LGAsWhen a planning proposal covers land within the Western Sydney Aerotropolis, it must be consistent with the Western Sydney Aerotropolis Plan published on 10 September 2020. This keeps development in the area aligned with that adopted plan.
This direction is one of the Minister's planning directions that constrains how councils and other planning authorities can rezone or otherwise change planning controls for land. It targets a very specific area — the Western Sydney Aerotropolis, the land around the new Western Sydney (Nancy-Bird Walton) International Airport. Its single purpose is to make sure any change to planning controls in that area lines up with the government's overarching blueprint for the Aerotropolis, the Western Sydney Aerotropolis Plan dated September 2020.
In practice, when one of the named councils (or another relevant planning authority) prepares a planning proposal affecting the relevant Aerotropolis land, the resulting controls must be consistent with that Plan. The Plan sets the objectives, planning principles and priorities for the area, and this direction gives those a mandatory hook: a planning proposal cannot simply depart from the Plan.
If a proposal is inconsistent, it cannot proceed unless the planning authority persuades the Planning Secretary (or a nominated departmental officer) that the inconsistency is only minor and that the proposal still achieves the overall intent of the Plan. It commenced on 1 March 2022 and replaced the earlier Direction 7.8.
Relevant planning authorities (in practice, the councils of Blacktown, Blue Mountains, Camden, Campbelltown, Fairfield, Liverpool, Penrith and Wollondilly, or any other body) preparing a planning proposal for the affected land.
It is triggered when a relevant planning authority prepares a planning proposal for land in the eight named LGAs that is the subject of Chapter 4 of the State Environmental Planning Policy (Precincts–Western Parkland City) 2021 (the Western Sydney Aerotropolis land).
A planning proposal may be inconsistent only if the relevant planning authority satisfies the Planning Secretary (or a nominated departmental officer) that the inconsistent provisions are of minor significance, and that the proposal achieves the overall intent of the Plan and does not undermine its objectives, planning principles and priorities.
The direction operates in connection with the Western Sydney Aerotropolis Plan (September 2020) and Chapter 4 of the State Environmental Planning Policy (Precincts–Western Parkland City) 2021. It replaces the previous Direction 7.8.
A planning proposal is to be consistent with the Western Sydney Aerotropolis Plan approved by the Minister and published on 10 September 2020 on the Department's website.
The obligation is confined to land in the eight listed local government areas that is the subject of Chapter 4 of SEPP (Precincts–Western Parkland City) 2021.
This direction does not apply to Kiama at all. It is confined to Western Sydney Aerotropolis land in the Blacktown, Blue Mountains, Camden, Campbelltown, Fairfield, Liverpool, Penrith and Wollondilly LGAs. Kiama is not a named LGA and contains no Aerotropolis land, so Kiama planners, applicants and certifiers have no obligations under it.
1.10 Implementation of the Western Sydney Aerotropolis Plan Objective The objective of this direction is to ensure development within the Western Sydney Aerotropolis is consistent with the Western Sydney Aerotropolis Plan dated September 2020. Application This direction applies when a relevant planning authority prepares a planning proposal for land in the Blacktown, Blue Mountains, Camden, Campbelltown, Fairfield, Liverpool, Penrith and Wollondilly local government areas that applies to land that is the subject of the chapter 4 of the State Environmental Planning Policy (Precincts- Western Parkland City) 2021. Direction 1.10 (1) A planning proposal is to be consistent with the Western Sydney Aerotropolis Plan approved by the Minister for Planning and as published on 10 September 2020 on the website of the Department of Planning and Environment. Consistency A planning proposal may be inconsistent with this direction only if the relevant planning authority can satisfy the Planning Secretary (or an officer of the Department nominated by the Secretary), that: (a) the provisions of the planning proposal that are inconsistent are of minor significance, and (b) the planning proposal achieves the overall intent of the Western Sydney Aerotropolis Plan and does not undermine the achievement of its objectives, planning principles and priorities for the Western Sydney Aerotropolis.
