Cherrybrook Station precinct proposals must match its Place Strategy.
Applies to: Land subject to the Cherrybrook Station Precinct Place Strategy in the Hornsby Shire and The Hills Shire LGAsWhen preparing a planning proposal for land covered by the Cherrybrook Station Precinct Place Strategy, the authority must ensure it is consistent with that Strategy. This supports the North District Plan and Greater Sydney Region Plan. Where it conflicts with Direction 1.16, this direction prevails.
This direction requires that any planning proposal (a proposal to amend a local environmental plan) affecting land within the Cherrybrook Station Precinct must line up with the Cherrybrook Station Precinct Place Strategy — a place-based plan approved by the Minister for Planning for the area around Cherrybrook Station on the North West Rail Link. The strategy sets the intended pattern of land use, density and development for the precinct, and this direction is the legal mechanism that forces LEP changes to follow it.
In practice, when a council (or other planning proposal authority) prepares a planning proposal for this land, it cannot simply set its own controls — it must ensure consistency with the approved Place Strategy. The direction also ties the local outcome back up to the broader strategic framework: the North District Plan and the Greater Sydney Region Plan. The consequence of inconsistency is that the proposal may be blocked or sent back unless the authority obtains the Secretary's agreement under the limited carve-out.
Planning proposal authorities (typically Hornsby Shire Council and The Hills Shire Council, or a delegate) preparing planning proposals for the affected land.
It is triggered when a planning proposal authority prepares a planning proposal for land subject to the Cherrybrook Station Precinct Place Strategy in the Hornsby Shire and The Hills Shire LGAs, as shown on Map Sheet LAP_001.
A planning proposal may be inconsistent only if the planning proposal authority satisfies the Secretary (or nominee) that the inconsistent provisions are of minor significance and that the proposal still achieves the overall intent of the Place Strategy.
It connects to the Cherrybrook Station Precinct Place Strategy, the North District Plan and the Greater Sydney Region Plan. A note states that where this direction is inconsistent with Ministerial Direction 1.16 North West Rail Link Corridor Strategy, this direction prevails to the extent of the inconsistency.
A planning proposal must be consistent with the Cherrybrook Station Precinct Place Strategy as approved by the Minister for Planning and published on the Department's website.
The direction is intended to actively support consistent delivery of objectives in the North District Plan and the Greater Sydney Region Plan.
This direction does not apply to Kiama. It is geographically confined to land within the Cherrybrook Station Precinct in the Hornsby Shire and The Hills Shire LGAs in north-western Sydney. A Kiama-scale coastal council would never trigger it; it is only relevant as an example of how place-based ministerial directions lock LEP changes to an approved precinct strategy.
1.22 Implementation of the Cherrybrook Station Place Strategy Objectives The objectives of this direction are to: (a) facilitate development within the Cherrybrook Station Precinct that is consistent with the Cherrybrook Station Precinct Place Strategy, and (b) actively support the consistent delivery of objectives in the North District Plan and Greater Sydney Region Plan. Application This direction applies when a planning proposal authority prepares a planning proposal for land subject to the Cherrybrook Station Precinct Place Strategy in the Hornsby Shire Council and The Hills Shire Council local government areas, as shown on Map Sheet LAP_001 Cherrybrook Station Precinct Place Strategy Ministerial Direction Map published on the Department of Planning and Environment website. Direction 1.22 (1) A planning proposal authority must ensure that a planning proposal is consistent with the Cherry brook Station Precinct Place Strategy, approved by the Minister for Planning and published on the Department of Planning and Environment website. Consistency A planning proposal may be inconsistent with the terms of this direction only if the planning prop osal authority can satisfy the Secretary of the Department of Planning and Environment (or their nominee), that: (a) the provisions of the planning proposal that are inconsistent are of minor significance, and (b) the planning proposal achieves the overall intent of the Cherrybrook Station Precinct Place Strategy. Note: In the event of any inconsistency between this Ministerial Direction and Ministerial Direction 1.16 North West Rail Link Corridor Strategy, this Ministerial Direction prevails to the extent of the inconsistency.
