Trading hours—temporary extension for unlicensed premises pt 2, div 3, sdiv 14: Ins 2020 (776), Sch 1. Rep 2008 (572), cl 2.132C. Ins 2025 (528), Sch 1[23]. 2.132A Specified development—extended trading hours during special events (1) The operation of premises until midnight during special events is development specified for this code if— (a) the development is subject to a council resolution that declares— (i) the event is a special event, and (ii) the date or dates on which the event will take place, and (iii) the extended trading hours that apply to the event, and (iv) the land on which the event is to take place, and (b) the development is at least 1 of the following— (i) community facilities, (ii) entertainment facilities, (iii) restaurants or cafes, (iv) shops, (v) take away food and drink premises, and (c) the development is none of the following— (i) a licensed premises under the Liquor Act 2007 , (ii) home occupations (sex services), (iii) restricted premises, (iv) sex services premises. Ins 2025 (528), Sch 1[23]. 2.132B Development standards The standards specified for development under this subdivision are as follows— (a) the development must be the subject of a development consent, (b) the development must comply with the conditions of the development consent, other than a condition that restricts the trading hours of the premises, (c) if the conditions of the development consent do not specify hours for the loading or delivery of goods to, or the removal of waste from, the premises—the loading or delivery of goods or removal of waste may only be carried out between 7am and 7pm on any day. cl 2.132B: Ins 2020 (776), Sch 1.
